Introduction

Zynex Technologies Pty Ltd ("CareCob") respects your privacy and handles personal information responsibly. By using CareCob, you acknowledge and consent to the handling of your information as described herein. This Policy complies with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the Notifiable Data Breaches (NDB) scheme.

Our Commitment and Legal Basis

CareCob complies with all applicable Australian privacy laws. As a digital AI-driven companion platform, we rely on third-party AI, voice, and cloud technologies and act as a facilitator rather than a healthcare provider. Users and caregivers remain responsible for the accuracy of information provided. CareCob disclaims liability arising from misuse, unauthorized integrations, or failures beyond reasonable control.

Purpose and Definitions

"Primary purpose" refers to the specific function or activity for which the information is collected. Any use or disclosure of personal information for another purpose is known as the "secondary purpose." "Health information" refers to information or an opinion about an individual's health, disability, expressed wishes regarding health services, or any health service provided to the individual, as defined under the Privacy Act 1988 (Cth).

We may collect personal, sensitive, and technical information including: • Personal data (name, contact details, caregiver/facility details) • Health information (wellbeing, conditions, or related details) • Conversational and voice recordings • Technical data (IP, device ID, diagnostics) • Aggregated anonymous analytics for improvement

Collection Methods

Information may be collected directly through AI interactions, service registration, or voice communications, and indirectly from authorised caregivers, healthcare providers, or integrated systems where consent is given.

Purpose of Data Use

Data is used to provide and improve CareCob services, personalise user experience, monitor wellbeing, notify caregivers, and ensure compliance with legal and operational obligations.

AI, Voice and Third-Party Technology Use

CareCob integrates third-party technologies including OpenAI (ChatGPT), Amazon Web Services, Google Cloud, and others that adhere to international compliance standards such as GDPR, SOC 2, and ISO-27001. While we align with these frameworks, CareCob is not liable for external provider failures or data handling outside our control. All AI interactions are informational and non-medical in nature.

Disclosure and Third-Party Involvement

Personal data may be shared only with authorised service providers, business partners, or regulatory authorities where legally required. We do not sell personal data, and all cross-border transfers comply with APP 8 and use secure, compliant systems.

Data Storage and Security

CareCob employs strong technical and organisational security measures, including encryption, access controls, and monitoring. While robust protections exist, no system is entirely risk-free, and CareCob disclaims liability for breaches beyond reasonable control.

Data Retention and Deletion

Personal data is retained only as long as necessary for operational or legal purposes, after which it is securely deleted or de-identified. Anonymous usage data may be preserved for analytical purposes.

Accuracy and User Responsibility

Users and caregivers must ensure that the data shared with CareCob is accurate and updated. CareCob shall not be held responsible for damages or inaccuracies resulting from user-provided information.

Access, Correction and Deletion Requests

Users may request access to, correction of, or deletion of their personal information by contacting support@carecob.com.au. Responses will be provided within 30 days subject to lawful exemptions.

Marketing and Communications

CareCob may send service updates or relevant communications, which users can opt out of at any time. Critical service notifications cannot be disabled.

Notifiable Data Breach Procedure

If a data breach likely to cause serious harm occurs, CareCob will assess and contain the issue within 30 days, notify affected users and the OAIC, and provide remedial steps. CareCob is not responsible for loss arising from external or user-related breaches.

Children, Caretakers and Vulnerable Individuals

CareCob is designed for adult users and caregivers. Accounts for dependents require verified guardian consent. Information from caregivers is handled in accordance with this policy and applicable laws.

Dispute Resolution

Privacy complaints can be addressed to support@carecob.com.au. If unresolved, users may contact the Office of the Australian Information Commissioner (www.oaic.gov.au). All disclaimers and limitations remain enforceable regardless of complaint status.
